📋 1. Acceptance of Terms

By downloading, installing, or using NurturedPet ("App," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and NurturedPet regarding your use of our Service.

🐾 2. Description of Service

NurturedPet is a pet medication management and wellness tracking application that provides:

• Medication scheduling, tracking, and reminders
• Health monitoring tools (including respiratory rate tracking, wellness assessments)
• AI-powered Care Companion for pet care guidance
• Vaccination record management
• Care Passport sharing features
• Caregiver support and wellness features

The Service is intended to assist pet caregivers in managing their pet's health routines. It is not a substitute for professional veterinary care.

✅ 3. Eligibility

To use NurturedPet, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

👤 4. Account & Data

4.1 No Account Required

NurturedPet does not require you to create an account. Your data is stored locally on your device by default.

4.2 iCloud Sync (Optional)

If you enable iCloud sync, your data will be stored in your personal iCloud account, subject to Apple's terms and conditions. You are responsible for maintaining the security of your Apple ID.

4.3 Data Responsibility

You are responsible for:

• The accuracy of information you enter
• Backing up your data
• Maintaining device security
• Any activity that occurs through your use of the App

🚦 5. Acceptable Use

5.1 Permitted Uses

You may use NurturedPet for its intended purpose: personal, non-commercial pet care management.

5.2 Prohibited Uses

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Interfere with or disrupt the Service or servers
• Circumvent any security features or access restrictions
• Use automated systems (bots, scrapers) to access the Service
• Resell, redistribute, or commercially exploit the Service
• Impersonate another person or entity
• Upload malicious code or content
• Use the AI features to generate harmful, abusive, or inappropriate content
• Attempt to extract training data or system prompts from AI features

⚕️ 6. Medical Disclaimer

6.1 Not Veterinary Advice

NurturedPet does not provide veterinary medical advice, diagnosis, or treatment. The App's features, including:

• Medication tracking and reminders
• AI Care Companion responses
• Health monitoring tools
• Pattern detection and insights

are designed to support your caregiving, not replace professional veterinary judgment.

6.2 Always Consult a Veterinarian

You should:

• Always consult a licensed veterinarian for diagnosis and treatment
• Never delay seeking veterinary care based on App information
• Never change medications or dosages without veterinary guidance
• Immediately contact a veterinarian or emergency clinic if your pet shows signs of illness, distress, or adverse reactions

6.3 Your Responsibility

You acknowledge that:

• All medical decisions regarding your pet are your responsibility
• The App cannot account for your pet's complete medical history
• AI responses are generated from general knowledge, not your pet's specific medical records
• Drug interactions, dosing, and side effect information may not be complete

🤖 7. AI Features & Limitations

7.1 AI Care Companion

NurturedPet includes AI-powered features using third-party AI services (Anthropic Claude). When using these features:

• Pet context (name, species, medications, etc.) is sent to process your requests
• AI responses are generated automatically and may contain errors
• We do not guarantee the accuracy, completeness, or reliability of AI responses
• AI features require an internet connection

7.2 AI Limitations

You acknowledge that AI features:

• May produce inaccurate or inappropriate responses
• Should not be relied upon for medical decisions
• Are not a substitute for professional advice
• May be unavailable during service disruptions
• May change or be modified at any time

7.3 Acceptable AI Use

You agree to use AI features only for their intended purpose (pet care support) and not to:

• Attempt to manipulate the AI to produce harmful content
• Use AI outputs in ways that could harm others
• Attempt to extract or reverse-engineer AI systems

©️ 8. Intellectual Property

8.1 Our Rights

NurturedPet and its entire contents, features, and functionality (including software, text, displays, images, audio, and design) are owned by NurturedPet and protected by copyright, trademark, and other intellectual property laws.

The NurturedPet name, logo, "Care Companion," "Care Passport," and related marks are trademarks of NurturedPet.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Use our trademarks without written permission
• Remove any copyright or proprietary notices
• Create derivative works based on the App

📝 9. User Content

9.1 Your Content

You retain ownership of content you create in the App, including pet profiles, notes, photos, and health logs ("User Content").

9.2 License to Us

By using the App, you grant us a limited license to process your User Content solely to provide the Service (e.g., displaying your pet's information, processing AI requests). We do not claim ownership of your content.

9.3 Content Responsibility

You are solely responsible for your User Content and represent that:

• You own or have rights to the content you upload
• Your content does not infringe third-party rights
• Your content does not violate any laws

💳 10. Subscriptions & Payments

10.1 Free and Premium Tiers

NurturedPet offers both free features and optional premium subscriptions ("NurturedPet Premium"). Core medication tracking features remain free.

10.2 Billing

Premium subscriptions are billed through Apple's App Store. All payments are processed by Apple and subject to Apple's terms.

• Subscriptions automatically renew unless canceled 24 hours before the renewal date
• You can manage subscriptions in your Apple ID settings
• Prices may vary by region and are subject to change

10.3 Refunds

Refund requests must be made through Apple. We do not directly process refunds. Please visit reportaproblem.apple.com for App Store refund requests.

10.4 Free Trial

We may offer free trials of Premium features. If you do not cancel before the trial ends, you will be charged the subscription fee.

🚪 11. Termination

11.1 Your Right to Terminate

You may stop using NurturedPet at any time by deleting the App. To delete your data, use the "Delete All Data" option in Settings before uninstalling.

11.2 Our Right to Terminate

We may suspend or terminate your access to the Service if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse our systems or other users
• For any other reason at our sole discretion

11.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• Local data remains on your device unless you delete it
• Active subscriptions may be canceled without refund for violations
• Provisions that should survive termination (disclaimers, limitations, etc.) will remain in effect

⚠️ 12. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That defects will be corrected
• That the Service is free of viruses or harmful components
• The accuracy, reliability, or completeness of any information

Some jurisdictions do not allow disclaimer of implied warranties, so some disclaimers may not apply to you.

⚖️ 13. Limitation of Liability

This includes, without limitation, damages arising from:

• Your use of or inability to use the Service
• Any pet health outcomes, including illness, injury, or death
• Errors or inaccuracies in content or AI responses
• Unauthorized access to your data
• Service interruptions or data loss
• Any third-party conduct or content

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow limitations on liability, so some limitations may not apply to you.

You agree to indemnify, defend, and hold harmless NurturedPet and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

🏛️ 15. Governing Law & Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved as follows:

1. Informal Resolution: We encourage you to contact us first to resolve any issues informally.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.
3. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

15.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or unauthorized access.

📝 16. Changes to Terms

We may modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• For material changes, we will notify you through the App or via email
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the Service

📎 17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NurturedPet.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 Waiver

Our failure to enforce any right does not waive that right.

17.4 Assignment

You may not assign these Terms. We may assign our rights to any successor.

17.5 No Third-Party Beneficiaries

These Terms do not create rights for any third party.
